America Derek Chauvin, a former Minneapolis police officer who died of a colored man George Floyd, asked the judge to remove the indictment from him.

Derek Chauvin's lawyer, who killed Floyd in the city of Minneapolis in May, stated that there is no plausible reason that the former policeman was charged with second-degree murder, that is.

Floyd, a 46-year-old colored man, died on May 25 after Chauvin held his neck for nearly 9 minutes.

Prosecutors said on August 28 that they would demand higher sentences than state regulations, if Chauvin and three former colleagues were found guilty, because they thought the killing of Floyd was too barbaric.

"Floyd has been treated particularly cruelly. Although he has begged that he is unable to breathe and is about to die, and begged for help from witnesses, the defendant and the other three remain in control.

Floyd's death triggered the "Critical Life of Black" protest movement that spread throughout the US and elsewhere around the world, spurring police reforms in America.

Attorney General Keith Ellison said it has not yet determined what the specific sentence is, but says the judge has a reason to do so.

Before Chauvin, the three former policemen also filed a petition to dismiss the prosecutor's indictment.

Chauvin faces up to 40 years in prison if convicted of second degree murder, 25 years imprisonment for third degree murder and 10 years imprisonment for manslaughter.
